New Delhi, November 05, 2021: A webinar on “Patenting in Pharmaceuticals” was organized by the Indian Pharmaceutical Association-Delhi State Branch (IPA-DSB) on September 04, 2021. More than 40 participants comprising the office bearers & executive council members of IPA-DSB, representatives from other pharmaceutical associations, pharma industry and students attended the online session.

Giving the welcome address, Kalhan Bazaz, President, IPA-DSB and Editor, The Indian Pharmacist stated, “Today’s webinar is the second in the weekly series which was started by IPA-DSB to enhance knowledge of the pharma professionals.” Regarding the webinar, he said, “The students should listen attentively to today’s speaker as the scope of pharma patenting in India is immense and an upcoming option for the students to make a career in this field.” Bazaz also gave a glimpse of the activities conducted by IPA on a regular basis. He ended, “If any participant has any topic in mind, then he or she can share with us and we will definitely try to take up the topic in our subsequent sessions.” Dr Neeraj Kumar, Hon. Secretary, IPA-DSB and Senior Clinical Research Manager, Translumina Therapeutics, Delhi was the moderator of the session.

Advocate Amrish Tiwari, Chairperson, Intellectual Property Rights (IPR) Forum, IPA-DSB and Partner, K&S Partners, New Delhi gave introductory remarks on the main theme of the webinar. He gave a brief description of the patents and said, “There is so much awareness about pharma patenting now and patenting is also linked with regulatory & other government policies.”

The speaker for the online session was Advocate Namrata Chadha, a gold medalist in both B. Pharm. & M. Pharm. and a patent attorney in the pharma-chemistry practice area of K&S Partners. In her presentation, Advocate Namrata highlighted types of pharma patents, salient features of Indian Patent Law, key sections relevant to pharma inventions, and what to claim in pharma patents. She also discussed common mistakes researchers make that harm patenting prospects like: researchers publish their invention in journals before patent filing date, discuss the invention in public forums like poster presentations & don’t keep their invention a secret until patent filing date, invention is not new, invention is too complex than the problem merits & its industrial applications are not well-defined, under-estimating the invention, obviousness issues ignored, half-baked ideas & all aspects / gaps of the problem not addressed by the inventor, no commercial / industrial utility, research / filing is delayed which destroys novelty, and wait for a perfect invention.
